  2. Nissan wants a judge to toss out a CVT lawsuit that they claim doesn’t point out any specific defects.

    The Massachusetts lawsuit says Nissan promoted their CVT as having a fluid-like performance, but that couldn’t be further from the truth for owners of the 2013-2014 Altima.

    The judge says the allegations are plainly sufficient and will allow the case to move forward.

  3. Does Nissan's automatic emergency braking (AEB) system have a defective radar?

    A California lawsuit says malfunctions in the system create random emergency braking situations when the radar detects objects that aren’t really there.

    The owner's manuals for many of the vehicles admit the automatic emergency braking systems do "not function in all driving, traffic, weather and road conditions.” But the plaintiff says the manual leaves out the part about how the systems can cause vehicles to suddenly stop even when no objects are in the driving lane.

    It’s scary to think that a safety system might actually create more crash scenarios than it prevents.

  4. A CVT lawsuit will proceed after a judge approved most of the plaintiffs' claims

    in a class-action Nissan asked the court to dismiss. The[lawsuit accuses the automaker of concealing transmission defects since 2012 and covers owners of the 2013-2014 Altima in California, New York, and Pennsylvania.

    Nissan argued those claims didn't hold because the plaintiffs had not adequately pleaded any of its express or implied warranty claims. However, the judge ruled claims about express and implied warranties survive, which automatically means Magnuson-Moss Warranty Act claims survive.

  6. Are the transmission cooling systems in Nissan’s Xtronic CVTs too small to handle the job?

    A recent lawsuit says so and thinks it’s time Nissan paid for their mistakes.

    The lead plaintiff says a simple warning light quickly escalated into a fried, useless transmission.

    The overheated CVT will send the Sentra into fail-safe mode which takes down the engine RPM to try to protect components from further damage, but drivers can expect vibrations, shaking and shuddering and then dealing with transmission failure.

    The sudden fail-safe mode can leave drivers in a dangerous position and it’s something Nissan has known about for years.

    The lawsuit covers all U.S. consumers who bought or leased a 2012-2017 Sentra with an Xtronic CVT.

  7. Nissan owners are tired of their timing chains whining, buzzing, ticking, and knocking their engines apart.

    In the case of Kobe Falco, et. al., v. Nissan North America, Inc., and Nissan Motor Company, LTD., the plaintiffs say they were forced to pay for expensive timing chain repairs which happened to fall ever-so-conveniently just outside of Nissan's warranty period. Earlier this year, the class-action was certified by a judge.

    So now Nissan has brought together their best engineers and a top-notch legal team to come up with their defense –– ok, our timing chains are noisy, but they're not a safety defect.

    From CarComplaints.com:

    "According to the automaker, there has never been anything defective about the timing chain systems and the most that owners can show is that the timing chains make noise, not that the systems are a safety risk. Nissan says the plaintiffs admit no crashes are attributed to the timing chains, even though the majority of the vehicles have been in service more than 10 years."

    So the case will attempt to answer are Nissan's timing chains just loud and annoying? Or are they loud, annoying, and potentially dangerous?

    The vehicles named in the suit all use the same uniform timing chain system: the 2004-2008 Maxima, 2004-2009 Quest, 2004-2006 Altima (VQ35 engine), 2005-2007 Pathfinder, 2004-2007 Xterra, and the 2005-2007 Frontier (VQ49 engine).

  8. A lawsuit has been filed in New Jersey saying the 2014 Sentra has a defective Continuously Variable Transmission (CVT)

    that shakes, jerks, has trouble accelerating, and experiences sudden downshifts. The lawsuit, Pinto of Montville Inc. v. Nissan North America, Inc, was filed by a garbage collection company which is oh so appropriate given the CVTs trashy reputation.

    "The plaintiff claims Nissan has concealed the defective transmissions while never ordering a recall, even after years of owner complaints. In addition, the automaker allegedly falsely advertised the transmissions as having fewer moving part to reduce friction and heat which makes the transmissions last longer."

    The lawsuit mentions that Nissan issued a warranty extension campaign, but that only included the 2007-2010 Sentra, not the 2014.

  9. Heads up, Nissan owners! The sunroof in your vehicle might soon be coming down in a thousand little pieces.

    A lawsuit alleges that all of Nissan's factory-installed sunroofs (panoramic or otherwise) can explode without warning. This includes any vehicle since 2008.

    "Plaintiff Janelle Horne says she was riding with her husband and four kids in a leased Infiniti QX80 when the sunroof exploded like a shotgun, causing Mr. Horne to pull off the highway and see shards of glass everywhere.

    Yikes, that'll get your attention. Hopefully this lawsuit means Nissan will start paying attention too.

    The lawsuit only includes residents of California at this time, but similar lawsuits may be filed nationwide based on its results.

  10. GT-R owners in Florida have sued Nissan for manufacturing defective dashboards that melt under the hot sun.

    And if there's one thing Floridians know, it's hot sun. According to the GT-R lawsuit, the plaintiff says he took the vehicle to a dealership and was told it would cost about $2,000 to replace the dashboard.

    Heuer says he asked Nissan to cover the cost of the replacement, but was told Nissan would not spend its money for the dashboard.

    Beyond cosmetics, the lawsuit says the melting dashboard is a hazard because:

    1. The dashboards become shiny and reflective, causing vision problems while driving.
    2. There's a noxious chemical smell emanating from the melted plastic.

    For now, the lawsuit is limited to Florida residents.

  11. If you're the owner of a Nissan 370Z equipped with a FS6R31A manual transmission

    and you're not a fan of the clutch pedals sticking to the floor, then this class-action lawsuit will probably be of interest to you.

    "According to the plaintiff, Nissan has known about the 370Z clutch problems since 2008 because of customer complaints, but the automaker concealed the alleged defect from consumers. The lawsuit also alleges the automaker has refused to reimburse owners for repairs to the transmission and failed to order a recall to fix the cars."

    The lawsuit says continued clutch problems cause excessive wear and tear on the transmissions. Not to mention the headaches from all the other drivers honking at you.

  12. A lawsuit says airbags in the Nissan Frontier are deploying without any reason.

    Nissan Frontier side airbag deployments have led to a proposed class-action lawsuit alleging the Frontier side airbags deploy for no reason. The lawsuit says the 2011-2012 Nissan Frontier trucks are dangerous because of the side airbags and Nissan refuses to fix the problems.

    The lawsuit says that a randomly deployed airbag goes off, it poses a serious distraction to drivers. It then goes on to say the sun is hot, ice cream is delicious, and everything's better with bacon.

  13. There is a serious danger lurking beneath the feet of 3rd-generation Altima owners.

    And since Nissan refuses to do anything about it, the issue has made its way to court. Plaintiff Marie DeMaria filed the proposed class-action lawsuit that alleges rust and corrosion can cause the floorboards to rust so severely the occupants can see the road. Additionally, the holes are deceptively dangerous because the interior carpet can hide the rust and corrosion from Altima owners.

    The problem is often concealed by the interior carpet and isn’t noticed until it’s too late. The rust often gets so bad that these vehicles can no longer pass state inspections without expensive repairs.
